1. Introduction

These Terms of Service apply to the use of the Lonkero software developed by Bountyy Oy. By using the software, you accept these terms in their entirety.

Lonkero is a web vulnerability scanner intended for use by security professionals, penetration testers, and organizations for testing their own or authorized systems.

2. Definitions

• Software: The Lonkero web vulnerability scanner and related services
• User: A person or organization that uses the software
• License: The right to use the software under certain conditions
• Target: A web service or system being scanned
• Service Provider: Bountyy Oy

3. License and Usage Rights

3.1 License Types

The software is offered with the following license types:

The license grants the user:

• The right to install and use the software on one device
• The right to scan targets within the limits of the license type
• The right to use the modules included in the license

The license does not grant the right to:

• Distribute, sell, or transfer the license to third parties
• Decompile, reverse engineer, or modify the software
• Circumvent technical protections or license validation
• Use the software for illegal purposes

3.3 Special Terms for Free License

The Free license is intended only for:

• Personal study and learning
• Non-commercial use
• Testing personal projects

The Free license may not be used for:

• Commercial activities
• Client projects
• Providing services to third parties

4. Permitted Use

4.1 User Commitments

The user commits to using the software only for:

• Testing their own systems
• Systems for which they have written permission from the owner
• In accordance with bug bounty program rules
• Within the scope of penetration testing agreements

4.2 Prohibited Use

The software may not be used for:

• Systems without authorization
• Denial of service attacks (DoS/DDoS)
• Illegal intrusion or data breaches
• Distributing malware
• Sending spam
• Disrupting critical infrastructure
• Activities that violate Finnish law or the laws of the user's jurisdiction

4.3 User Responsibility

The user is solely responsible for:

• Obtaining necessary permissions before scanning
• Ensuring the legality of the scan target
• Any damages resulting from the use of the software
• Compliance with local laws and regulations

5. Service Operation

5.1 License Server

The software requires a connection to Bountyy Oy's license server to operate. The server:

• Validates license validity
• Authorizes scanning and available modules
• Signs scan results

5.2 Offline Mode

If connection to the server cannot be established:

• The software operates in limited mode
• Only Free license features are available
• Results cannot be signed

5.3 Service Availability

Bountyy Oy strives to keep the service available 24/7 but does not guarantee uninterrupted operation. The service provider is not responsible for:

• Scheduled maintenance windows
• Technical disruptions
• Interruptions caused by third parties

6. Payments and Billing

6.1 Pricing

License prices are determined by the current price list. Prices are published on the website.

6.2 Payment Methods

Payments are processed through Stripe.. Accepted payment methods:

• Credit and debit cards
• Bank transfer
• Invoice (business customers)

6.3 License Validity

• Licenses are valid for the period indicated at purchase
• The license takes effect upon payment confirmation
• The license key is delivered by email

6.4 Refunds

Due to the nature of digital products:

• No refunds are available after payment
• Exception: technical defects that completely prevent use of the software

7. Intellectual Property Rights

7.1 Ownership

All rights to the software, its source code, documentation, and trademarks belong to Bountyy Oy.

7.2 User-Generated Content

The user owns the scan results and reports. Bountyy Oy does not have access to actual scan results.

7.3 Feedback

User feedback and development suggestions may be used in software development without compensation.

8. Limitation of Liability

8.1 Software Status

The software is provided "as is". Bountyy Oy does not guarantee:

• Error-free operation
• Suitability for a particular purpose
• Uninterrupted operation
• Detection of all vulnerabilities

8.2 Damages

Bountyy Oy is not liable for:

• Indirect or consequential damages
• Business interruptions
• Data loss
• Third-party claims

Bountyy Oy's total liability is limited to license fees paid by the user in the last 12 months.

8.3 User Liability

The user agrees to defend Bountyy Oy and compensate all claims, damages, and expenses arising from:

• Violation of these terms
• Unauthorized scanning
• Illegal activities

9. License Revocation and Blocking

9.1 Grounds for Revocation

Bountyy Oy may revoke the license immediately if the user:

• Violates these terms of service
• Uses the software illegally
• Attempts to circumvent license validation
• Shares the license key with third parties

9.2 Blocking

Bountyy Oy may block user access to the service based on:

• IP address
• Device identifier
• License key
• Network operator (ASN)

9.3 Consequences

License revocation or blocking:

• Does not entitle to a refund
• Takes effect immediately
• May be done without prior warning in serious violations

10. Privacy

Terms regarding the processing of personal data are described in a separate privacy policy.

11. Changes to Terms

Bountyy Oy reserves the right to modify these terms. Changes will be communicated:

• By email to license holders
• On the website

Continued use of the software after changes constitutes acceptance of the terms.

12. Applicable Law and Dispute Resolution

12.1 Applicable Law

Finnish law applies to these terms.

12.2 Dispute Resolution

Disputes are primarily resolved through negotiation. If agreement cannot be reached, disputes are resolved in the Helsinki District Court.

12.3 Consumer Protection

For consumer customers, mandatory provisions of consumer protection law apply.

13. Sanctions and Export Control

13.1 Export Control Compliance

The Product may not be used, exported, re-exported, transferred, assigned, or otherwise made available in violation of EU, Finnish, or other applicable sanctions legislation or export control regulations, including but not limited to EU Regulation 2021/821 (Dual-Use Regulation) and EU sanctions concerning Russia.

13.2 Prohibition of Use for Russia

The use of the Product in Russia or for the benefit of Russia is prohibited, regardless of whether such use occurs directly or indirectly, including but not limited to use through a third country, on behalf of, or for the account of a third party.

13.3 Sanctioned Parties

The Product may not be used, transferred, or made available to any person, organization, or other entity that is listed on the sanctions lists of the EU, United Nations, United States, or any other applicable authority.

13.4 User Representations

The User represents and warrants that they:

• Are not a citizen, permanent resident, or legal entity subject to the laws of Russia or Belarus; and
• Are not acting on behalf of or for the account of any such party.

13.5 Third-Party Access

The User undertakes not to permit the use of or access to the Product by any third parties where the User knows or reasonably should know that such use would be in conflict with sanctions or export control regulations.

13.6 Suspension of Access

The Company reserves the right to suspend or block access to the Product immediately and without liability for compensation if the Company has reasonable grounds to suspect a violation of this section or if applicable sanctions legislation or export control regulations so require.
